Terms of Service

Welcome to EuKreate. These Terms of Service ("Terms") govern your access to and use of the EuKreate website, platform, and services (collectively, the "Service") operated by EuKreate, Inc. ("Company," "we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

EuKreate is an AI-powered digital presence and buyer engagement platform for real estate professionals. EuKreate assembles per-agent EuKreate Intelligence from the agent's content, the listings the agent adds, and third-party property and neighborhood data, and uses it to power EuKreate-hosted, AI- and search-optimized agent websites and listing pages, an embedded assistant placed on the agent's own website, lead-capture forms, booking and tour workflows, QR codes and share links, and connected messaging platforms.

Most provisions of these Terms are written for real estate professionals who create EuKreate accounts ("Agent Users"). Prospective buyers and other visitors who interact with EuKreate-hosted agent pages, EuKreate-hosted listing pages, an embedded EuKreate assistant on an agent's website, a lead-capture form, a booking or tour workflow, QR codes and share links, or a connected messaging platform ("Buyer Visitors") are subject to these Terms only to the extent relevant to their use of those buyer-facing features.

Geographic Availability: The Service is currently available only to users located in the United States and its territories. We do not currently market, offer, or direct the Service to individuals outside the United States. We reserve the right to expand geographic availability in the future, at which time these Terms will be updated accordingly.

1. Description of Service

EuKreate is an AI-powered digital presence and buyer engagement platform for real estate professionals, including agents, brokers, and agencies. The Service may include:

  • EuKreate Intelligence, a per-agent intelligence built from agent-provided content, the listings you add, publications, public records, and third-party property and neighborhood data
  • EuKreate-hosted, AI- and search-optimized agent websites and listing pages
  • Buyer-facing assistants and Q&A experiences on EuKreate-hosted pages
  • An embedded assistant that may be placed on your own website
  • Lead-capture, booking, call, callback, and tour workflows
  • Buyer-agent messaging through email relay and connected messaging platforms
  • An agent dashboard for reviewing, editing, publishing, unpublishing, sharing, and managing leads
  • Analytics, QR codes and share links, and export features
  • Ingestion of content from your existing online presence to build and update EuKreate Intelligence

The Service is configured around your professional real estate presence, the listings you add, your local expertise, and your buyer-facing digital surfaces. During early access, EuKreate may set or modify usage, listing, messaging, generated-page, or publishing limits for your account to support testing, product development, cost management, and service reliability.

What the Service is not: EuKreate is not an MLS, IDX provider, listing portal, brokerage, real estate marketplace, legal advisor, financial advisor, property valuation service, appraisal service, tenant-screening service, credit-reporting agency, or substitute for professional judgment. We do not create or own listings; agents add their existing listings so the assistant, EuKreate Intelligence, hosted pages, lead management, and analytics can run on them. Content surfaced by EuKreate Intelligence and the assistant does not constitute real estate, legal, financial, or professional advice. You are solely responsible for ensuring that all listing content and your responses to buyers comply with applicable real estate laws, fair-housing requirements, advertising regulations, and licensing rules in your jurisdiction.

1.1 Agent Users and Buyer Visitors

Agent Users use the account dashboard to manage their profile and the listings they add, build and review their EuKreate Intelligence, publish and manage EuKreate-hosted pages and the embedded assistant, manage leads, and route buyer communications. Buyer Visitors use the buyer-facing surfaces — including EuKreate-hosted pages, the embedded assistant, lead-capture forms, booking and tour flows, QR codes and share links, and connected messaging platforms where available — to ask questions, provide contact information, request a tour or callback, or otherwise engage. Buyer Visitors do not need to create an account to use the buyer-facing surfaces.

By using the buyer-facing surfaces, Buyer Visitors acknowledge that their messages, contact information, listing activity, and booking details may be shared with the applicable listing agent and processed by EuKreate as described in our Privacy Policy. Buyer Visitors must not misuse the assistant or other buyer-facing surfaces, submit unlawful or abusive content, attempt to circumvent security or fair-housing safeguards, or submit sensitive personal information that is not needed for a real estate inquiry.

No Guarantee of Lead Exclusivity. EuKreate does not guarantee exclusivity of leads, buyer relationships, inquiries, or property interest. Buyers may independently contact agents, brokerages, property owners, or third-party platforms outside the Service, and EuKreate is not responsible for resulting commission, referral, or representation disputes between agents, brokerages, or other parties.

1.2 Public Pages and Search/AI Discoverability

EuKreate-hosted pages may be structured to support discoverability by search engines and AI-powered search tools. You acknowledge that EuKreate does not control third-party search engines, AI systems, browsers, crawlers, indexes, summaries, rankings, citations, or cached copies, and that such third parties are not EuKreate service providers unless separately contracted. EuKreate does not guarantee that any public page will be indexed, ranked, cited, summarized, surfaced, or that it will generate placement, visibility, traffic, leads, tours, or closed transactions.


2. Eligibility

To create an account or use the agent dashboard, you must:

  • Be located in and a resident of the United States or its territories (the Service is not available to persons outside the United States)
  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable laws, including U.S. export-control laws, sanctions, and embargoes
  • Provide accurate and complete registration information

If you are using the Service on behalf of a business, brokerage, or organization, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" refers to both you individually and the entity you represent.

Buyer Visitors must be at least 18 years old, located in the United States or its territories, and legally able to use the buyer-facing features.


3. Account Registration

To access the agent dashboard, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Complete the onboarding process (personal information, business information, brand settings, and listing addition)
  • Maintain and update your information to keep it accurate and current
  • Maintain the security of your password and account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activities that occur under your account

You may register using email/password or through supported third-party authentication providers. When using third-party authentication, you authorize us to access certain account information from those providers as described in our Privacy Policy.

We reserve the right to refuse registration, suspend, or terminate accounts at our discretion if we reasonably believe that account information is inaccurate or that the account is being used in violation of these Terms.


4. Content, Generated Content, Public Pages, and Data Rights

4.1 Your Content

Your Content includes content you submit, upload, connect, authorize us to ingest, or make available to the Service, including:

  • Website URLs and website content
  • Public profiles and publications
  • Testimonials and reviews you provide or authorize
  • Property descriptions, listing details, and disclosures
  • Logos, brand assets, and headshots
  • Uploaded documents and materials
  • Agent profile, service, and process descriptions and local-expertise information
  • Any knowledge-base entries, FAQs, or other context you supply

By submitting, connecting, uploading, or authorizing Your Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, transmit, ingest, extract, summarize, structure, transform, generate derivative content from, display, publish, host, and distribute Your Content and EuKreate-generated content through EuKreate-hosted pages, embedded assistants, share links, QR codes, and other Service surfaces, and to structure, publish, and make Your Content and EuKreate-generated content available in ways that support search-engine and AI-powered search discoverability, solely to provide and operate the Service for you. The worldwide scope is necessary because content may be stored on geographically distributed cloud infrastructure. This license does not allow EuKreate to use Your Content for EuKreate's own unrelated marketing or for model training. This license terminates when you delete the content or close your account, except for backup, compliance, and retention purposes as described in Section 12.

Public display. Some content you approve, publish, or make available through EuKreate-hosted pages will be displayed publicly and may be crawled, indexed, cached, or summarized by third parties as described in Section 1.2 and our Privacy Policy.

You represent and warrant that you own or have the necessary rights to all content you submit, including content from submitted URLs you authorize us to ingest, and that your content does not infringe on any third party's intellectual property or other rights.

4.2 Buyer Data and the Agent's Role

Information that buyers submit through EuKreate-hosted agent pages, EuKreate-hosted listing pages, the embedded assistant, lead-capture forms, booking workflows, QR codes and share links, email relay, and connected messaging platforms is collected on your behalf as the listing agent (or, where you are configured as the buyer agent for a particular lead, on the buyer agent's behalf). With respect to that information, you act as the data controller for buyer engagement data where applicable and EuKreate acts as your data processor, except that EuKreate acts as an independent controller for security, fraud prevention, suppression-list maintenance, abuse detection, platform analytics, and other purposes described in our Privacy Policy. You are responsible for using buyer data lawfully — including obtaining any required consents, honoring opt-out requests, and complying with applicable real estate, fair-housing, and consumer-protection laws.

You are solely responsible for ensuring that your communications with buyers, including communications routed through EuKreate messaging channels (email relay, connected Facebook Pages, and any other messaging integrations you connect), comply with applicable anti-spam, telemarketing, consumer-protection, and real-estate communication laws, including the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA) where applicable, and any applicable state laws.

The Service also lets you add leads manually and import contact lists (for example, a CSV export from another CRM, an open-house sign-in sheet, or your past-client or sphere list), and to send a single personalized message to several selected leads at once ("broadcasts"). By importing contacts you represent and warrant that you have the right and any legally required consent to store those contacts and to contact them, and that your use complies with applicable privacy, anti-spam, and consumer-protection laws. Broadcasts are your communications, sent by you as the agent; EuKreate delivers them individually through its relay, skips suppressed recipients, and includes opt-out handling, but does not review or approve their content and is not the sender. You are solely responsible for the lawfulness of the contacts you import and the messages you send, and you agree to indemnify and hold harmless EuKreate from any claims arising from your import of contacts without a proper legal basis or from communications that violate applicable law.

4.3 Data Processing Terms

When EuKreate processes buyer personal data on your behalf as a processor, the following data-processing terms apply unless you and EuKreate enter into a separate written data processing agreement.

  • Instructions: you instruct EuKreate to process buyer personal data as necessary to provide, secure, support, and improve the Service; route buyer communications and booking requests; maintain suppression lists; comply with law; and perform the processing described in these Terms and the Privacy Policy.
  • Controller responsibilities: you are responsible for providing required notices, establishing any required legal basis or consent, responding to buyers where you are the controller, and using buyer data only in compliance with applicable law and your own privacy commitments.
  • Processor commitments: EuKreate will process buyer personal data only on your documented instructions, except where applicable law requires otherwise; restrict access to authorized personnel and service providers; maintain reasonable technical and organizational safeguards; and assist with privacy-rights requests and security incidents as reasonably required for the Service.
  • Sub-processors: you authorize EuKreate to use the service providers and sub-processors described in our Privacy Policy or made available on request. EuKreate remains responsible for requiring sub-processors to protect buyer personal data in a manner consistent with our obligations.
  • Return or deletion: upon termination or deletion request, EuKreate will delete or make available for export buyer personal data in accordance with the retention periods in these Terms and the Privacy Policy, subject to legal, security, suppression-list, backup, and dispute-resolution retention requirements.
  • Compliance information: upon reasonable request, EuKreate will provide information reasonably necessary to demonstrate compliance with these data-processing terms, such as summaries of relevant safeguards or processor practices. Any audit rights beyond reasonable written information requests require a separate written agreement.

4.4 Property Rights and Authorization

By adding a listing to the Service, you represent and warrant that:

  • You have all necessary legal rights, permissions, and authorizations to market the property featured in the listing, including under any applicable agency agreement, MLS rules, or brokerage policy
  • If you are acting on behalf of a property owner, you have obtained proper written authorization from the property owner to market the property
  • You have obtained all necessary consents, licenses, and permits required under applicable laws and regulations to market the property
  • The property information you provide is accurate and you are authorized to disclose it
  • Any photo-compliance record you enter for a listing — a link to the original, unmodified photos, or a certification that the uploaded photos are not digitally modified (for example, under California AB 723) — is accurate at the time you record it, and you will update it if the listing's photos change

EuKreate does not verify property ownership, agency relationships, marketing authorizations, or whether listing photos have been digitally modified. Photo-compliance fields record what you attest to; they do not constitute legal advice and do not replace your own or your brokerage's compliance review.

You agree to indemnify and hold harmless EuKreate from any claims, damages, or liabilities arising from your unauthorized use of property information or from disputes about your right to market a property through the Service.

4.5 Content Restrictions

You agree not to use the Service to create or distribute content that:

  • Infringes on any third party's intellectual property rights
  • Is defamatory, obscene, pornographic, or offensive
  • Promotes violence, discrimination, or illegal activities
  • Contains false, misleading, or deceptive property information
  • Violates fair-housing laws or engages in discriminatory advertising
  • Misrepresents property features, conditions, or availability
  • Impersonates any person or entity
  • Manipulates the assistant, EuKreate Intelligence, or generated content to circumvent fair-housing requirements, real estate advertising rules, or platform policies

4.6 Buyer-Facing Surfaces and Embedded Assistant

The Service may be delivered to buyers through EuKreate-hosted pages, an embedded JavaScript assistant you place on your own website, share links, QR codes, lead-capture forms, booking flows, and connected messaging platforms. Your right to use these surfaces is a personal, limited, non-transferable, revocable license tied to your active early access account and to the listings and content you have added to the Service.

You may not embed the assistant on pages whose content you do not control, on pages that violate these Terms, or on pages that misrepresent your relationship to a property; you may not modify, decompile, or wrap the assistant or any Service surface to disguise its origin; and you may not misrepresent the source of EuKreate-hosted pages or generated content. These surfaces may display privacy, AI, and terms notices to buyers before or during use, and you may not remove, obscure, disable, or bypass those notices. EuKreate may update, modify, unpublish, or disable any buyer-facing surface (including EuKreate-hosted public pages) at any time, and your continued use constitutes acceptance of those updates.

EuKreate Sites index page. EuKreate operates an index page at eukreate.site that links to agent-published sites and to a limited, rotating selection of published listing pages. Where your site and listings are published and eligible, an entry may appear there showing your name, brokerage, and, for a listing, its address, price, bed/bath/size figures and a photo you have uploaded, each linking to your own EuKreate-hosted page. EuKreate does not represent the properties shown and does not act as a broker, marketplace, or listing aggregator; the publishing agent remains responsible for the listing and receives all buyer enquiries. You may opt out of this index page from your dashboard settings; opting out does not unpublish your site or your listing pages.

Sold listings remain published. When you mark a listing sold, its EuKreate-hosted listing page remains published and publicly accessible, clearly labelled as sold with the sale date, until you unpublish or delete it or your account is terminated. Tour requests, open-house RSVPs and other scheduling actions are disabled on a sold page, and a sold listing is removed from the eukreate.site index page. Keeping the page live preserves the accumulated search value of a URL that has already been shared and indexed; if you would rather it were removed, unpublish or delete the listing.

4.7 Company Intellectual Property

The Service, including its design, features, code, algorithms, AI prompts and orchestration, templates, and documentation, is owned by the Company and protected by intellectual property laws. Nothing in these Terms grants you any right to use the Company's trademarks, logos, or brand features without prior written consent.

4.8 Generated Content

The Service may generate page copy, listing summaries, buyer Q&A, conversation drafts, recommendations, and other outputs ("Generated Content") based on Your Content, listing data, public records, third-party data, and EuKreate Intelligence. Subject to these Terms, EuKreate grants you a limited, non-exclusive, revocable license to use Generated Content for your real estate marketing and buyer engagement through the Service and related agent-controlled marketing channels. EuKreate retains all ownership of the Service, templates, prompts, workflows, orchestration, software, and underlying technology. Generated Content may be similar to content generated for other users and is not guaranteed to be unique, accurate, or complete; you are responsible for reviewing it before publishing or relying on it.

You may edit, approve, publish, unpublish, or (where made available in the Service) export Generated Content. Publishing Generated Content through EuKreate-hosted pages makes it publicly accessible, subject to Section 1.2.


5. EuKreate Intelligence and AI Features — Limitations and Responsibility

EuKreate Intelligence and the Service's AI features use third-party large-language-model and AI providers to generate outputs. These AI providers support uses including:

  • generated agent website content;
  • generated listing pages and summaries;
  • buyer Q&A;
  • embedded-assistant responses;
  • connected-messaging responses;
  • conversation summaries;
  • lead-qualification signals;
  • draft recommendations for agent review;
  • content moderation and compliance-risk screening; and
  • spoken narration and voice synthesis for generated videos and the optional buyer voice experience.

You acknowledge and agree that:

  • Inputs: outputs are generated from the listings you add, brand information, ingested content, and knowledge-base content you provide, supplemented by neighborhood and property data from third-party sources. The accuracy and completeness of outputs depend directly on the inputs you provide.
  • Output limitations: AI-generated outputs (including generated pages, summaries, and assistant responses) may contain inaccuracies, omissions, outdated information, or statements that do not comply with real estate advertising, fair-housing, or local rules. You are solely responsible for reviewing the configuration and outputs across surfaces and correcting any inaccuracies before publishing or relying on them.
  • No advice: outputs are for buyer engagement and information only and do not constitute legal, financial, real estate, or professional advice.
  • Content moderation: the Service applies automated moderation to AI inputs and outputs. Flagged content may be blocked or recorded for review.
  • Provider tier: where available, we use API or enterprise-tier AI services under terms that restrict use of customer data for model training. If our AI providers materially change their data-use practices, we may update these Terms and our Privacy Policy as required.
  • No duty to monitor: the Company has no obligation to monitor, review, filter, or guarantee the legality, accuracy, or appropriateness of AI outputs, and does not undertake any duty to do so beyond automated moderation.

Lead-Qualification Signals. Lead-qualification signals are used to help agents understand buyer interest and prioritize follow-up. They are not used to determine a buyer's eligibility for housing, financing, pricing, or access to the Service.

Fair-Housing Safety. EuKreate Intelligence and AI features are not intended to generate, publish, recommend, or answer based on protected characteristics (such as race, color, religion, national origin, sex, familial status, disability, sexual orientation, gender identity, or source of income), neighborhood demographics, school quality used as a proxy for protected traits, perceived "safety" stereotypes, or other criteria that could violate the Fair Housing Act or analogous state or local laws. We may block, refuse, or redirect certain inputs and outputs to reduce fair-housing compliance risk. You are responsible for ensuring that any context, content, or instructions you provide do not direct the Service to produce content that violates fair-housing requirements. Where the Service provides school, safety, hazard, or neighborhood information, such information is informational and may be based on third-party or public data; you are responsible for ensuring that your use of such information does not become a proxy for discriminatory steering or other prohibited conduct.

Buyer-Facing AI Disclosure. Buyer Visitors acknowledge that certain AI outputs — including responses delivered within connected messaging platforms such as Facebook Messenger — may be generated automatically by AI systems operating on behalf of the listing agent.

No Emergency Use. The Service is not intended for emergency communications, urgent housing decisions, or time-sensitive legal or financial matters. Users should not rely on the Service where immediate professional assistance is required.

Evolving AI Behavior. AI-generated behavior, workflows, and response quality may evolve over time as models, prompts, safeguards, and product functionality change. The Service may introduce, modify, or remove AI-driven features at any time consistent with these Terms.

No Automated Legally Binding Decisions. The Service does not make legally binding decisions on behalf of users regarding contracts, offers, financing, tenant screening, housing eligibility, or any similar matter. AI-generated outputs are informational only; any decision with legal, financial, or fair-housing consequence must be made and executed by a qualified human (the agent, broker, buyer, seller, or their professional advisors).


6. Buyer ↔ Agent Messaging Channels (Email Relay and Connected Messaging Platforms)

The Service can deliver messages between buyers and agents over more than one channel: an email relay operated by EuKreate, and optional integrations with third-party messaging platforms (most notably Facebook Messenger) that you may connect to your EuKreate account.

EuKreate is a software platform and not a telecommunications carrier, email provider, or social-media platform operator. Where the Service relays messages over third-party channels, delivery, retention, and platform-specific rules are governed by the underlying provider's own terms in addition to these Terms.

6.1 Email Relay and Suppression

The Service routes messages between buyers and agents through a third-party messaging-relay provider, using per-thread reply addresses on a dedicated relay subdomain. You agree that:

  • Email content sent or received through the relay may be processed by the relay provider for delivery, threading, and abuse detection
  • The Service maintains a suppression list. The following events always cause a buyer's address to be suppressed: a "STOP" or "UNSUBSCRIBE" reply or similar opt-out keyword; a hard bounce; or a spam complaint. Once suppressed, agent replies addressed to that buyer through the Service will not be delivered
  • You must not use the relay to send unsolicited bulk messages, attempt to bypass the suppression list, or engage in any practice that would cause the Service to violate the CAN-SPAM Act or other anti-spam laws
  • EuKreate does not guarantee delivery of any individual message and is not responsible for messages held or rejected by the recipient's mail provider

6.2 Connected Messaging Platforms (e.g., Facebook Messenger)

Authorization to act on the connected account's behalf. By connecting a Facebook Page or other supported messaging account to the Service, you authorize EuKreate to receive messages sent to that account through the applicable platform APIs and webhooks, send replies on your behalf through those platforms, maintain synchronized inbox records, and perform the messaging workflows described in the Privacy Policy. This authorization remains in effect for each connected account until you disconnect it from your EuKreate settings or remove EuKreate's access from the platform's own settings.

Processing, monitoring, and retention. Messages routed through the Service may be processed, monitored, retained, and analyzed for delivery, synchronization, abuse prevention, moderation, customer support, audit logging, and operational improvement of the messaging and support features of the Service, as described in the Privacy Policy. Operational analytics and service-improvement activities do not include selling buyer data, sharing messaging content with data brokers, using messaging content for third-party advertising purposes, or training third-party AI models on customer data beyond what our AI providers' contractual terms permit.

Platform compliance. You remain responsible for complying with each connected platform's own terms when using these integrations, including (where applicable) the Meta Platform Terms, Messenger Platform Policies, and any platform-specific advertising, spam, or automated-messaging restrictions. You must not use these integrations to send unsolicited outreach, bulk promotional campaigns, or messages unrelated to a conversation a buyer has initiated with the connected account.

SMS Alert Terms

SMS alert terms. By separately opting in to EuKreate SMS alerts, you agree to receive operational text messages concerning buyer inquiries, tour requests, listing escalations, and related account activity. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for assistance. Consent to SMS is not a condition of purchasing EuKreate services. Wireless carriers are not liable for delayed or undelivered messages. EuKreate may change or discontinue the SMS alert program subject to applicable requirements. SMS alerts are an agent-only operational channel and are not used to send marketing messages or to contact buyers.

Quiet Hours and Urgent Alerts

Quiet hours. You may set quiet hours during which EuKreate will not send you text messages. Outside of an urgent-alert consent described below, alerts that arise during your quiet hours are held and delivered once the window ends. Setting quiet hours does not affect messages you receive in the EuKreate portal or by email.

Urgent alerts during quiet hours are a separate, optional consent. Agreeing to receive text messages from EuKreate does not by itself permit us to text you during your quiet hours. If you choose to allow it, you may separately consent to receive a text message outside your quiet hours in one narrow circumstance: a buyer is waiting on an answer that EuKreate Intelligence cannot answer on your behalf. We record the date and time of that consent, the page it was given on, and the exact wording shown to you at the time.

This consent is optional, is never required to use EuKreate or any paid plan, and can be withdrawn at any time in your notification settings. It also ends automatically if you withdraw consent to receive text messages at all, including by replying STOP — an urgent-alert consent never outlives the SMS consent it depends on. Withdrawal takes effect on the next message; we retain the record that consent was given and withdrawn.


7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service, servers, or networks
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated systems, bots, scrapers, crawlers, or data-extraction tools to access the Service, EuKreate-hosted pages, the embedded assistant, APIs, or generated content without permission (this does not restrict standard search-engine and AI-powered search crawling that we permit through published crawl directives such as robots.txt)
  • Resell, sublicense, or redistribute the Service or access to it without authorization
  • Use the Service to build a competing product or service
  • Circumvent any usage limits, listing caps, restrictions, or security measures
  • Share account credentials with unauthorized third parties
  • Submit content that contains malware, viruses, or harmful code
  • Use the Service to send unsolicited communications or spam
  • Access the Service from any country or territory subject to U.S. government sanctions or embargoes, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. We reserve the right to use commercially reasonable technical measures (such as IP geolocation) to detect and prevent access from sanctioned regions.

8. Third-Party Services, Data Sources, and Search/AI Systems

Our Service integrates with, relies on, or interacts with various third-party services and data sources, including:

  • AI inference providers: OpenAI, and other configured AI providers such as Anthropic if enabled, for AI-generated responses, generated page content, summaries, moderation, and other EuKreate Intelligence features.
  • Cloud infrastructure providers: AWS.
  • Voice synthesis / voice cloning: ElevenLabs, for spoken narration in generated videos, the optional buyer voice experience, and the opt-in "Use Your Own Voice" voice clone.
  • SMS / phone verification: Twilio, for one-time agent phone-number verification codes.
  • Authentication providers: e.g., Google.
  • Email service providers: Amazon SES; Gmail SMTP for limited non-listing notifications.
  • Buyer-agent messaging relay: Postmark.
  • Property / neighborhood / public-records data providers: e.g., Rentcast (property facts), Foursquare (points of interest), SchoolDigger and NCES (schools), the FBI Crime Data API (crime statistics), FEMA, USGS, OpenAQ, and the FCC (flood, seismic, air-quality, and broadband data), and the U.S. Census Bureau and FRED (demographic and market data); additional providers as introduced.
  • Map / geocoding providers: Geoapify; Google Maps Platform for geocoding and drive-time/commute estimates.
  • Website ingestion / content-import infrastructure: used to analyze submitted websites and materials.
  • AI safety / content-moderation providers: where used.
  • Tour scheduling: tour bookings are delivered as iCalendar (.ics) invitations by email. If you have connected a calendar (see below), EuKreate writes your own events straight to that calendar and omits the duplicate .ics from your copy of the email; the email itself is still sent, and the buyer and any co-operating agent still receive their .ics invitation. You may also share an optional external scheduling link.
  • Connected calendar (optional): you may connect one calendar account — Google Calendar or Microsoft/Outlook — to EuKreate. Connecting is optional; EuKreate’s built-in scheduling works without it. When you connect a calendar, you authorize EuKreate to (a) read your busy/free times so buyers are not offered a time you are already booked, and (b) create, update, and delete the tour, call, and open-house events that EuKreate itself schedules for you, on a dedicated calendar named “EuKreate” that we create in your account. EuKreate does not read the titles, descriptions, attendees, or other contents of your other events, and does not modify calendars other than the one it creates. Appointments you book outside EuKreate are never imported as EuKreate bookings or leads; they appear only as opaque busy time. We store the resulting OAuth access and refresh tokens in encrypted form while the connection remains active, and delete them when you disconnect the calendar or close your account. You may disconnect at any time in your EuKreate settings, or revoke EuKreate’s access from Google’s or Microsoft’s own account settings.
  • Social-publishing providers (where enabled): where you turn on optional social-publishing features and connect social accounts, the platforms' own APIs — the Meta Graph API (Facebook and Instagram), the YouTube Data API, the TikTok Content Posting API, and the LinkedIn API — are used to publish your scheduled promotion content to those platforms. Connecting a social account authorizes EuKreate to publish the promotion posts you schedule to that account automatically, without a separate per-post approval step; this authorization stays in effect until you pause the promotion or disconnect the account from your EuKreate settings (or remove EuKreate's access from the platform's own settings). Some integrations may instead upload your content to the connected account as a draft for you to review and publish yourself. You remain responsible for the promotion content you schedule and for complying with each connected platform's terms. For any other network, EuKreate can generate ready-to-post copy that you publish yourself; EuKreate does not post to or track those.

Your use of these third-party services through the Service is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services. Temporary unavailability of third-party services may affect certain features of the Service.

Search engines and AI-powered search tools. Public content on EuKreate-hosted pages may be crawled, indexed, cached, summarized, or processed by third-party search engines, AI-powered search tools, browsers, or other services under their own policies. These third parties are not EuKreate service providers unless separately contracted, and EuKreate does not control and is not responsible for their collection, retention, ranking, citation, or use of publicly available content.

You agree to comply with all applicable third-party platform policies and developer requirements when using integrations provided through the Service, including (where applicable) the Meta Platform Terms, Messenger Platform Policies, the Google API Services User Data Policy, the TikTok Developer Terms of Service, and the LinkedIn API Terms of Use. Failure to comply with a third-party platform's terms may, at our discretion, result in suspension or removal of the corresponding integration from your account.

Some connected messaging integrations may be beta, subject to platform approval, or unavailable until activated by EuKreate.


8A. Reader Comments on EuKreate Articles

This Section applies to anyone who reacts to or comments on an article published at eukreate.com/articles. You do not need an account to do so, and this Section applies whether or not you are otherwise a user of the Service.

8A.1 Your Content and the Licence You Grant

You retain ownership of what you write. By submitting a comment you grant EuKreate a non-exclusive, worldwide, royalty-free, perpetual and irrevocable licence to host, store, reproduce, publish and display that comment, together with the display name you supplied, on and in connection with the Service. You represent that the comment is yours to submit and does not infringe anyone else's rights.

Comments are public. Once published, your comment and the display name you supplied are visible to anyone who visits the article. They may also be read, copied, indexed, cached and reproduced by search engines, AI answer engines, and other automated systems that we do not control, and may remain available through those systems after removal from our site. Do not include anything in a comment that you would not want published permanently, and do not include your own or anyone else's personal contact details.

8A.2 Prohibited Content

You must not submit a comment that:

  • expresses or implies a preference, limitation or discrimination based on race, color, religion, sex, familial status, national origin, disability, or any other class protected by the federal Fair Housing Act or applicable state or local law; characterizes who lives in an area; steers readers toward or away from a neighborhood; or describes a place as suited to a particular kind of person or family;
  • is unlawful, defamatory, harassing, threatening, or abusive;
  • impersonates any person or misrepresents your affiliation;
  • contains another person's private information, including an address, telephone number or email address;
  • is commercial solicitation, spam, or posted primarily to place a link; or
  • infringes any intellectual-property right.

8A.3 Moderation and Removal

All comments are screened automatically and, for first-time commenters and for any comment the screen flags, reviewed by a person before publication. We may refuse, remove, edit for length, unpublish or delete any comment, and block any commenter, at our sole discretion and without notice. Comments that raise a fair-housing concern are never published automatically under any circumstances.

We are not obligated to publish any comment, to keep a published comment available, or to preserve any comment after removal. Comments are the views of the individuals who post them and are neither endorsed by, nor the responsibility of, EuKreate.

8A.4 Email Verification

First-time commenters must confirm a one-time code sent to the email address they supply. That address is not published and is used only as described in the Privacy Policy. You may request deletion of your comment and the associated record at any time by contacting support@eukreate.com.

8A.5 Who May Comment

You must be at least 18 years of age to react to or comment on an article. Section 2 sets this requirement for account holders and Buyer Visitors; it applies equally here, because commenting requires you to give us an email address. The comment features are not directed to children. We do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has submitted a comment or an email address to us, contact support@eukreate.com and we will delete the comment and the associated record.

9. Free Early Access

The Service is currently offered as a free early access product. During the early access period, we do not charge subscription fees and do not require you to provide a payment method to use the Service.

Early access is provided for evaluation, testing, feedback, and pre-launch use. We may accept, limit, suspend, or discontinue early access at any time in our discretion.

Capacity and usage limits: during early access, we may set or modify limits on the number of active listings, active or published pages, enabled buyer-facing surfaces, assistant or AI requests, website-ingestion volume, generated pages, messaging integrations, QR codes and share links, assistant embeds, storage, data-enrichment calls, sessions, leads, messages, exports, calendar connections, or other usage of the Service. These limits may vary by user, account, brokerage, or testing arrangement and may be changed at any time to protect the Service, manage costs, or support product development.

Active listing and active page. An "active listing" means a listing for which the assistant, lead capture, buyer activity tracking, EuKreate Intelligence, or a related listing workflow or page is enabled or available to visitors. An "active page" or "enabled surface" means an EuKreate-hosted page, embedded assistant, or other buyer-facing surface that is published or available to visitors. Draft, archived, duplicated, test, unpublished, and hidden-from-visitors listings and pages do not count toward your active totals.

No paid subscription during early access: unless we separately agree with you in writing, your use of the Service during early access is free of charge. The Service does not currently offer paid subscriptions, per-listing add-ons, on-demand listing purchases, or per-lead overage charges.

Future paid plans: we may introduce paid subscription plans, usage limits, listing-capacity tiers, or other pricing in the future. If we introduce paid plans, we will provide notice before charging you. You will not be charged unless you affirmatively select a paid plan, provide a valid payment method, and authorize payment.

Taxes: because the Service is currently free during early access, no subscription taxes are charged. If paid plans are introduced later, applicable taxes may be added to your invoice as required by law.


10. Data Export and Portability

10.1 Export Options

Export options may vary by data type. You may export your leads and engagement data as CSV files at any time while your account is active, and we recommend maintaining local copies. Generated pages, EuKreate Intelligence and knowledge-base records, enriched third-party property and neighborhood data, templates, prompts, and system-derived metadata may not be fully exportable, except where required by law or where an export option is made available in the Service.

10.2 Post-Termination Access

After you request account termination, your data will remain available for export during the retention period described in Section 12.1. After the retention period, your data will be permanently deleted from primary systems.

During the retention period, you may request reactivation from the restricted account-deletion page. Reactivation cancels your pending termination request and restores account access, subject to these Terms.

10.3 Data Portability Requests

You may request a copy of your personal data in a portable format by contacting us at privacy@eukreate.com, as described in our Privacy Policy.


11. Service Availability and Modifications

We strive to maintain reasonable availability but do not guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the Service at any time
  • Perform maintenance that may temporarily affect availability
  • Add, update, or remove features, functionality, or user interface elements
  • Change usage limits or restrictions

Notice of material changes: for changes that materially reduce the functionality of the Service, we will provide reasonable advance notice via email and/or in-app notification before such changes take effect. This notice requirement does not apply to emergency security patches, third-party service disruptions, or changes required by law.

Third-party dependency: the Service relies on third-party AI providers, messaging-relay providers, and cloud infrastructure. Outages or changes by these providers may temporarily affect Service functionality. We are not liable for disruptions caused by third-party service issues.

No SLA: no service-level agreement (SLA) applies unless expressly set forth in a separate written agreement signed by the Company.

No Duty to Monitor: the Company has no obligation to monitor user activity or content across the Service.

11.1 Beta and Experimental Features

From time to time, we may offer features designated as "beta," "preview," "experimental," or similar labels. Beta features are provided "as-is" and "as available" without any warranties of any kind. Beta features may be incomplete, contain bugs, behave unpredictably, be modified or discontinued at any time without prior notice, are not covered by any service-level commitments, and should not be relied upon for production or business-critical use. Your use of beta features is voluntary and at your own risk.


12. Termination, Unpublishing, and Data Retention

12.1 Termination by You

You may terminate your account at any time through your account settings or by contacting us at contact@eukreate.com. Account termination follows a phased process designed to protect your data while respecting your right to deletion:

  • Immediate effects: upon requesting termination, your ability to add new listings, manage active listings, and use the agent dashboard will cease; EuKreate-hosted public pages (agent site and listing pages) will be unpublished or deactivated; QR codes and share links will stop working; the embedded assistant on your pages will be disabled; lead-capture and booking flows will stop accepting submissions; and connected messaging integrations (such as a connected Facebook Page) will be disabled within EuKreate and, where supported by the upstream provider, disconnected or unsubscribed using commercially reasonable efforts, with stored credentials deleted when your account is purged as described in Section 12.4.
  • Early access account termination: because the Service is currently provided free of charge during early access, termination does not result in any refund or billing adjustment. Your data will remain available for export during the retention period described below.
  • 30-day retention period: beginning from the date you request termination, your leads, chat transcripts, listing data, and engagement timelines will remain available for export for thirty (30) days. After this period, primary-system data will be permanently deleted (backup copies will be purged within an additional thirty (30) days).
  • Reactivation during retention: during the thirty (30) day retention period, you may request reactivation from the restricted account-deletion page. Reactivation cancels your pending termination request, restores dashboard access to retained account data, and returns your account to active status. AI assistant widgets, automated posting, and automated replies that were disabled when termination was requested remain disabled until you turn them back on.
  • After final purge: once the retention period has expired and primary-system data has been permanently deleted, prior account data cannot be restored. You may create a new account using the same email address or OAuth identity, subject to these Terms.
  • Suppression-list entries created during your use of the Service will be retained as required by anti-spam law, notwithstanding termination.

12.2 Termination by Us

We may terminate or suspend your account and access to the Service:

  • Immediately, without prior notice, for: violation of these Terms or our content policies; fraudulent, abusive, or illegal activity; repeated content-moderation violations; spamming through the messaging relay; or conduct that poses a security risk to the Service or other users
  • With reasonable written notice, for any reason or no reason (termination for convenience). Because the Service is currently provided free of charge during early access, no refund or billing adjustment is owed on termination for convenience.

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately, except for the limited purpose of exporting your data during the retention period described in Section 12.1
  • Tour booking will stop accepting new requests; calendar invitations already emailed for confirmed tours remain in recipients' own calendars under their calendar provider's terms
  • EuKreate-hosted public pages will be unpublished or deactivated, QR codes and share links will stop working, embedded assistants will be disabled, connected messaging integrations will be disabled within EuKreate (and we will make commercially reasonable efforts to revoke or remove stored platform credentials where applicable), and lead-capture and booking flows will stop accepting submissions; where applicable, an embedded assistant may instead display an inactive message or fallback contact method
  • Any unused listing-cap headroom is forfeited and has no cash value

12.4 Data Retention After Termination

After the retention period described in Section 12.1, the following data will be permanently deleted from our primary systems:

  • Listing data and associated content
  • Buyer leads, chat transcripts, and engagement timelines
  • User-uploaded brand assets, logos, and headshots
  • Generated EuKreate website and listing-page content, including content in draft, review, published, unpublished, or archived states
  • EuKreate Intelligence and knowledge-base records, including generated listing summaries and buyer Q&A
  • Enriched third-party property and neighborhood context associated with your account
  • Buyer conversation memory carried across surfaces

Deletion from primary systems is subject to backup retention, legal retention, suppression-list retention, and the public-cache caveat below.

The following data will be retained in accordance with our Privacy Policy for the purposes of legal compliance, financial record-keeping, dispute resolution, and internal analytics:

  • Account identifiers and profile information (name, email, company)
  • Subscription and payment transaction history, if paid plans are introduced in the future (retained as required by applicable tax and financial regulations)
  • Buyer-agent messaging relay metadata (retained for twelve (12) months)
  • Suppression-list entries (retained as required by anti-spam law)
  • Usage and activity logs (retained for twelve (12) months)
  • Content moderation records

This retained data is used solely for compliance, security, dispute resolution, service administration, and aggregate analytics. If paid plans are introduced in the future, payment-related records may also be used for financial reporting. It is not used to rebuild your account or for marketing purposes.

Public-cache caveat. When EuKreate-hosted pages are unpublished or deleted, we remove them from active public EuKreate systems and, where technically feasible, update our sitemaps and crawl directives so removed pages are no longer listed for crawling. However, copies may remain temporarily in backups and may already have been crawled, indexed, cached, summarized, or archived by third-party search engines, AI systems, browsers, or other services outside EuKreate's control, which retain or remove such copies under their own policies and timing.

12.5 Surviving Provisions

Sections 4 (Content, Generated Content, Public Pages, and Data Rights), 6 (Buyer-Agent Messaging Channels obligations), 7 (Acceptable Use), 8 (Third-Party Services, Data Sources, and Search/AI Systems), 9 (Free Early Access), 10 (Data Export and Portability, where applicable), 12 (Termination, Unpublishing, and Data Retention), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Indemnification), 17 (Copyright and DMCA Policy), 18 (Governing Law and Disputes), 19 (Electronic Communications, where applicable), and 21 (General Provisions) survive termination.


13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OR RELIABILITY OF AI-GENERATED OUTPUTS, EUKREATE INTELLIGENCE OUTPUTS, GENERATED PAGE CONTENT, LISTING SUMMARIES, BUYER Q&A, LEAD-QUALIFICATION SIGNALS, CONVERSATION SUMMARIES, OR MESSAGING RESPONSES

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • AI-generated outputs, EuKreate Intelligence outputs, generated page content, listing summaries, buyer Q&A, or messaging responses will be accurate, complete, or suitable for your purposes
  • AI-generated outputs will comply with local real estate advertising regulations or fair-housing rules in your jurisdiction
  • EuKreate-hosted pages will be indexed, ranked, cited, summarized, or surfaced by any search engine or AI-powered search tool, or will generate any placement, visibility, traffic, leads, tours, or transactions
  • Messages sent through the buyer ↔ agent messaging relay will be successfully delivered to, accepted by, or remain available with the recipient's mail provider
  • Calendar invitations, external scheduling links, or calendar-related workflows will remain available, accepted, or functional
  • Any errors in the Service will be corrected

13.1 No Reliance; User Verification Requirement

The Service and all outputs generated through the Service, including AI-generated outputs, EuKreate Intelligence outputs, generated pages, listing summaries, buyer Q&A, and assistant responses, are provided for buyer engagement and informational purposes only. You acknowledge and agree that:

  • You do not rely on the Service or any AI-generated content as a substitute for professional judgment, legal compliance, or independent verification
  • You are solely responsible for monitoring AI outputs and generated content across your Service surfaces and correcting inaccuracies
  • You will ensure that all listing content and your responses to buyers comply with applicable laws, regulations, and industry standards, including real estate advertising laws and fair-housing requirements
  • You are solely responsible for ensuring that your use of the Service complies with all applicable advertising, consumer protection, and unfair-or-deceptive-practices laws

The Company shall not be responsible for any decisions, actions, or omissions taken by you based on the Service or any AI-generated content.

13.2 Security Disclaimer

While the Company implements commercially reasonable administrative, technical, and organizational safeguards to protect user data, no system can be guaranteed to be completely secure. You acknowledge that the transmission of data over the internet involves inherent risks. To the maximum extent permitted by law, the Company shall not be liable for any unauthorized access to or use of your data, except to the extent required by applicable law.

AI identification to visitors: The buyer assistant identifies itself to visitors as an AI assistant acting for you, and never as you personally. It does so in its opening message and, when a visitor asks directly whether they are speaking with a person, it answers plainly that it is an AI assistant and offers to connect them with you. This applies on every surface and to every configuration, including where you have named the assistant after yourself, where your photograph is displayed alongside its messages, and where you have enabled your own cloned voice. You may choose the assistant's name, voice, and presentation, but you may not configure or instruct the Service to present the assistant as a human being or to deny being an AI.

Real estate compliance disclaimer: EuKreate is an AI-powered digital presence and buyer engagement platform, not a licensed real estate broker, agent, or legal advisor. AI-generated outputs, EuKreate Intelligence outputs, generated pages, listing summaries, and assistant responses may contain inaccuracies, omissions, or statements that do not comply with your jurisdiction's real estate advertising regulations, fair-housing laws, or MLS rules. You are solely responsible for reviewing AI configuration, generated content, and outputs for accuracy, legal compliance, and suitability before publishing or relying on them across any Service surface.


14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from unauthorized access to your account
  • Damages resulting from AI-generated outputs, EuKreate Intelligence outputs, or generated public-page content, including inaccurate property information or regulatory non-compliance
  • Damages resulting from third-party search engines or AI systems crawling, indexing, caching, summarizing, ranking, citing, or failing to remove public EuKreate-hosted pages
  • Damages resulting from any failure to achieve search ranking, AI visibility, traffic, lead generation, tours, or transactions
  • Damages resulting from inaccuracies in third-party property, neighborhood, school, hazard, safety, market, or public-record data
  • Damages resulting from third-party service-provider failures or outages, including AI providers, messaging-relay providers, calendar providers, or cloud infrastructure
  • Damages resulting from the failure, delay, or rejection of messages sent through the buyer ↔ agent messaging relay
  • Damages resulting from expired, revoked, or invalid OAuth credentials
  • Damages exceeding the greater of (a) one hundred U.S. dollars ($100) or (b) the total amount paid by you to us in the twelve (12) months preceding the claim

This limitation applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.

Exceptions: nothing in this section shall limit or exclude liability for: (a) death or personal injury caused by gross negligence or willful misconduct; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under applicable law.


15. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit, connect, upload, authorize us to ingest, publish, or display, including listing data, ingested website content, and knowledge-base content
  • Your handling of buyer data collected through the Service, including any failure to honor opt-out requests, fair-housing violations, or unauthorized contact
  • Generated Content you review, approve, publish, share, or use, and AI-generated outputs surfaced from configuration or content you provided, including claims arising from inaccurate property information or regulatory non-compliance
  • Claims arising from your EuKreate-hosted public pages
  • Claims arising from your use of school, safety, hazard, neighborhood, market, or public-record data
  • Claims arising from your use of connected messaging platforms
  • Your breach of any applicable real estate laws, advertising regulations, or fair-housing rules
  • Your use of the buyer ↔ agent messaging relay in violation of anti-spam law or these Terms

Carve-out: your indemnification obligation does not apply to the extent a claim, loss, or liability arises from the Company's own gross negligence, willful misconduct, or violation of applicable law. The Company will promptly notify you of any claim for which it seeks indemnification, allow you to control the defense and settlement of the claim (provided that no settlement may impose any obligation or admission on the Company without its prior written consent), and reasonably cooperate at your expense.


16. Force Majeure

Neither party shall be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including natural disasters, acts of government, power outages, internet disruptions, third-party service-provider outages (including AI providers, messaging-relay providers, cloud infrastructure, and, if paid plans are introduced, payment processors), pandemics, war, terrorism, labor disputes, or cyberattacks. In the event of a force-majeure event lasting more than thirty (30) consecutive days, either party may terminate these Terms upon written notice.


17.1 Respect for Intellectual Property

EuKreate respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA") and applicable law.

17.2 Filing a DMCA Takedown Notice

  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner

17.4 Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification with: your physical or electronic signature; identification of the material that was removed and where it appeared before removal; a statement under penalty of perjury that you have a good-faith belief that the material was removed by mistake or misidentification; and your name, address, and telephone number, plus a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located, and that you will accept service of process from the person who submitted the takedown notice or that person's agent.

17.5 Repeat Infringers

We may terminate the accounts of users who are determined to be repeat infringers at our sole discretion.


18. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.

18.1 Informal Resolution

Before initiating any formal proceedings, both parties agree to attempt to resolve any dispute arising from these Terms or the Service through good-faith negotiation for a period of at least thirty (30) days after written notice of the dispute.

18.2 Binding Arbitration

If a dispute cannot be resolved through informal negotiation, the parties agree to resolve the dispute through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. This arbitration agreement is governed by the Federal Arbitration Act (9 U.S.C. §§ 1–16) and shall be enforceable in accordance with its terms. The arbitration shall take place in Contra Costa County, California, unless otherwise required by applicable law or mutually agreed. The arbitrator's decision shall be final and binding.

Arbitration costs: for claims under $75,000, the Company shall pay all AAA filing fees and arbitrator compensation. For claims of $75,000 or more, the AAA's fee schedule shall apply, with each party bearing its own attorneys' fees unless the arbitrator determines otherwise.

30-Day Right to Opt Out: you may opt out of this arbitration agreement by sending written notice to contact@eukreate.com within thirty (30) days of first accepting these Terms. Your notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of the arbitration provision.

18.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTE-RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.

PAGA Exception: nothing in this class-action waiver shall be construed to waive, limit, or otherwise affect any rights or claims under the California Private Attorneys General Act (PAGA), Labor Code § 2698 et seq., to the extent that such waiver is prohibited by applicable law.

18.4 Small Claims Exception

Notwithstanding the arbitration provision, either party may bring an individual action in small claims court in Contra Costa County, California, for disputes within the court's jurisdictional limits.

18.5 Injunctive Relief

Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights or confidential information.


19. Electronic Communications

By creating an account and using the agent dashboard, Agent Users consent to receive electronic communications from us, including account verification and security notifications, transactional emails related to use of the Service, lead alerts and booking confirmations, service updates and announcements, and marketing communications (which may be opted out of at any time).

Buyer Visitors who submit contact information through the buyer-facing features consent to receive transactional or relationship communications related to their inquiry, tour request, booking, follow-up from the applicable agent, and opt-out or suppression-list administration. Buyer Visitors may opt out of future buyer-facing messages as described in the Privacy Policy or in the message itself.


20. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on our website with a new "Last Updated" date
  • Sending an email to your registered email address at least thirty (30) days before material changes take effect
  • Displaying a notice within the Service

Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the revised Terms, you must stop using the Service and may terminate your account.


21. General Provisions

  • Entire Agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior agreements and understandings.
  • Conflict with Privacy Policy: in the event of a conflict between these Terms and the Privacy Policy, the provisions of these Terms shall control with respect to liability, limitations, and dispute resolution, unless otherwise required by applicable law.
  • Severability: if any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
  • Waiver: the failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
  • Assignment: you may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations under these Terms freely, including in connection with a merger, acquisition, or sale of assets.
  • Notices: all notices to the Company should be sent to contact@eukreate.com. Notices to you will be sent to the email address associated with your account.
  • Headings: section headings are for convenience only and do not affect the interpretation of these Terms.
  • Relationship of Parties: nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and the Company.
  • No Third-Party Beneficiaries: these Terms are for the benefit of the parties hereto and are not intended to confer any rights or benefits on any third party.
  • Disputes Between Users: the Company is not responsible for disputes between users of the Service, including disputes arising from competing listings, conflicting marketing claims, or overlapping content for the same property. Users are solely responsible for resolving any disputes with other users directly.
  • Brokerage Supervision: EuKreate is a software tool used by individual real estate professionals and is not responsible for supervision, licensing, training, advertising-review, or recordkeeping obligations imposed on brokers or brokerages under applicable real estate laws, MLS rules, or brokerage policies. Each Agent User is responsible for using the Service in compliance with their own brokerage's supervisory framework.
  • Export Compliance: the Service is controlled and operated from the United States. You agree to comply with all applicable U.S. export-control laws and regulations, including the Export Administration Regulations and sanctions programs administered by the Office of Foreign Assets Control (OFAC).
